Terms and Conditions

This agreement is between AGILEPM HUB ("AGILEPM HUB", "we", "us", or "our") and you, the user of our websites and services ("you" or "User"). It governs your access to and use of agilepmhub.com, and any sub domains, content, products, and services we operate (collectively, the "Website").
By accessing or using the Website, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Website.
Important: Clauses relating to purchases (see Sections 9–13) apply when you buy e learning, live training, or related services from us.

1. Definitions 

Account: The profile and credentials you create to access the Website and any paid content.
Content: Text, graphics, images, audio, video, software, data compilations, templates, downloads, and other materials available on or via the Website.
Facilities: Any online features, tools, services, or information made available on the Website.
Paid Content / Services: Our e‑learning courses, instructor‑led bootcamps, coaching, templates, and any other paid offerings.
Payment Information: Details required to pay for Services (e.g., card data, bank details), processed by our payment partners.
User Content: Any content a User submits (e.g., posts, comments, reviews, assignments).

Services are provided from Hong Kong. Currency is shown in USD unless otherwise stated. If you wish to pay in another currency, please contact us directly before placing your order.

3. Age and Eligibility

The Website is intended for users 18+. If you are under 18, you may use the Website only with the involvement and consent of a parent or legal guardian, who must be the bill‑payer for any purchases.

4. Business Customers

These Terms apply to both consumers and business customers. If you purchase on behalf of a business, you confirm you have authority to bind that business to these Terms.

5. Intellectual Property

  • 5.1 Unless otherwise indicated, all Content and underlying code on the Website is owned by or licensed to AGILEPM HUB and is protected by applicable laws.
  • 5.2 You are granted a limited, non‑exclusive, non‑transferable licence to access and use the Website and, where applicable, Paid Content for your personal, non‑commercial use only.
  • 5.3 Except as permitted by law or by express written permission from us, you must not copy, reproduce, modify, distribute, sell, license, frame, scrape, or create derivative works from any part of the Website or Content.
  • 5.4 Third‑party names, logos, and marks are the property of their respective owners and used for identification purposes only.

6. User Content and Acceptable Use

  • 6.1 You are responsible for User Content you submit and for your use of the Website. Do not submit content that is unlawful, infringing, defamatory, abusive, misleading, or that contains malware or unsolicited promotions.
  • 6.2 You grant AGILEPM HUB a worldwide, royalty‑free, transferable licence to host, store, reproduce, and display your User Content for the purpose of operating and improving the Website and Services.
  • 6.3 You must not: (a) harass or impersonate others; (b) attempt to gain unauthorised access; (c) use automated means to access the Website; (d) share your Account or allow others to use your credentials; (e) circumvent any access or usage limits.
  • 6.4 We may monitor, remove, or refuse any User Content that breaches these Terms.

7. Accounts and Security

  • 7.1 You may need an Account to access parts of the Website or Paid Content. Provide accurate information and keep it up to date.
  • 7.2 Keep your password secure. You are responsible for all activity under your Account. Notify us immediately of any unauthorised use.
  • 7.3 We may suspend or terminate Accounts that breach these Terms or pose security risks.

8. Links

  • 8.1 The Website may contain links to third‑party sites. We are not responsible for their content, availability, or practices. Use at your own risk.
  • 8.2 You are welcome to link to our Website, including deep links to specific public pages (such as course descriptions), provided that you do so in a fair and lawful way that does not damage our reputation or take unfair advantage of it.

9. Products and Services

  • 9.1 E‑learning (self‑paced): Individual licence for one natural person. You must not share, resell, or make Content available to others or on any public or private repository. Access is typically granted immediately after successful payment.
  • 9.2 Live training / bootcamps / coaching: Dates, times, modality (virtual or in‑person), and prerequisites will be shown at checkout or in joining instructions. We may set minimum/maximum cohort sizes.
  • 9.3 Third‑party exams/vouchers (e.g., PMI, PeopleCert): Where offered, these are subject to the third party’s terms. Availability and pricing may change; vouchers are usually non‑refundable once issued.
  • 9.4 Team/enterprise licences: May include separate terms. If your organisation provides you access, your access may end when your employment/engagement ends or your organisation’s licence expires.

10. Prices, Taxes, and Changes

  • 10.1 Prices are shown in USD unless stated otherwise and may change from time to time. The price at checkout is the price that applies. If you require payment in another currency, please contact us directly before purchasing.
  • 10.2 Taxes: You are responsible for any applicable duties, or withholding taxes unless we explicitly state that taxes are included.
  • 10.3 We reserve the right to change or discontinue Content or features; we will not materially reduce access to content you have already purchased without providing an equivalent or a refund pro‑rata for any paid unused period (if applicable).

11. Orders and Payment

  • 11.1 Your order is an offer to buy. A contract forms when we send an order confirmation or when access to Paid Content is made available, whichever occurs first.
  • 11.2 Payments are processed by reputable third‑party payment processors. We do not store full card details.
  • 11.3 If payment fails or is reversed, we may suspend access until resolved.
  • 11.4 For subscriptions (if any), billing recurs per the plan until cancelled in accordance with Section 12.

12.Cancellations, Refunds, and Rescheduling

Our default policy (subject to any product‑specific terms shown at checkout):
  • 12.1 E‑learning (digital content): Because access is granted immediately, all sales are final once access or download has started. If you have not accessed the course, you may request a refund within 14 calendar days of purchase.
  • 12.2 Live training / bootcamps: You may cancel for a full refund if requested at least 14 calendar days before the scheduled start date. Within 14–7 days, you may request a free reschedule to a later cohort (subject to availability). Within 7 days, cancellations or no‑shows are non‑refundable; reschedules may incur a fee.
  • 12.3 Provider cancellations: If we cancel a class or materially change dates, you may choose a full refund or a free transfer to a future cohort.
  • 12.4 Vouchers/exams: Non‑refundable once issued unless the issuer permits otherwise.
  • 12.5 How to cancel: Contact support@agilepmhub.com with your order number and details. Eligible refunds are typically processed within 5–14 calendar days back to the original payment method.

13. Access, Availability, and Support

  • 13.1 We aim for high availability but do not guarantee uninterrupted access. Downtime may occur for maintenance, outages, or events beyond our control.
  • 13.2 Minimum technical requirements (browser, bandwidth) apply; you are responsible for meeting them. 
  • 13.3 Support is available via support@agilepmhub.com. We endeavour to respond promptly but do not guarantee specific response times.

14. Privacy and Data Protection

  • 14.1 Our Privacy Policy explains how we collect and process personal data. By using the Website, you agree to our Privacy Policy.
  • 14.2 We comply with Hong Kong’s Personal Data (Privacy) Ordinance (Cap. 486) and, where applicable, international data protection laws (e.g., GDPR) for users located in those jurisdictions.
  • 14.3 We use third‑party processors (e.g., payment gateways, learning platform providers) under appropriate contracts and safeguards.

15. Disclaimers

  • 15.1 The Website and Content are provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non infringement.
  • 15.2 Training content is for educational purposes and does not guarantee exam success, job placement, or specific business outcomes.
  • 15.3 While we use reasonable efforts to keep content accurate and up to date, occasional errors or omissions may occur.

16. Limitation of Liability

  • 16.1 To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or exemplary damages, loss of profits, revenue, data, or business interruption, arising from or related to your use of the Website or Services.
  • 16.2 Our total aggregate liability for any claim shall not exceed the total fees you paid to us for the Service giving rise to the claim in the 12 months preceding the event.
  • 16.3 Nothing in these Terms limits liability that cannot be excluded by law (e.g., fraud, death or personal injury caused by negligence).

17.Indemnity

You agree to indemnify and hold harmless AGILEPM HUB, its officers, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your User Content, or your misuse of the Website.

18. Events Outside Our Control

We are not liable for failure or delay due to events beyond our reasonable control, including natural disasters, power or internet failures, platform outages, war, civil disorder, epidemics, or legal/regulatory action.

19.Changes to the Website or these Terms

We may update the Website and these Terms from time to time. Changes take effect when posted. Your continued use after changes means you accept the updated Terms. If required by law, we will give specific notice.

20. Termination

We may suspend or terminate access to the Website or your Account if you materially breach these Terms, create risk or possible legal exposure for us, or if we discontinue the Website. You may stop using the Website at any time. Sections that by nature should survive (e.g., IP, limitations, indemnity, governing law) will continue to apply.

21. Communications

Official notices to us must be sent to support@agilepmhub.com or to our registered address. Notices are deemed received on the next business day in Hong Kong after sending by email (if no bounce) or three business days after posting.

22. No waiver; Severability; Entire Agreement

Failure to enforce a right is not a waiver. If any provision is held invalid, the remainder remains in effect. These Terms constitute the entire agreement between you and us regarding the Website and Services.

23. Third Party Rights

No person other than AGILEPM HUB and you has any rights to enforce these Terms.

24. Governing Law and Jurisdiction

These Terms and any dispute or claim (including non contractual disputes) are governed by the laws of Hong Kong SAR. The courts of Hong Kong SAR have exclusive jurisdiction, without prejudice to any mandatory rights you may have under local consumer law.

25. Contact and Complaints

We welcome questions, feedback, and complaints at support@agilepmhub.com. We aim to resolve issues promptly and fairly.

Product specific Addenda 

A. Refund policy for instructor‑led courses (mirrors Section 12):

  • ≥14 days before start: full refund
  • 14–7 days: free reschedule (subject to availability)
  • <7 days / no‑show: non‑refundable; reschedule fee may apply

B. Academic Integrity

  • Do not share answers to assessments or distribute proprietary templates. Accounts suspected of cheating or content scraping may be suspended or terminated.

C. Media consent (optional; use if you record live classes)

  • Live sessions may be recorded for quality and cohort replay. You will be notified if session is recorded. By attending, you consent to being recorded. If you prefer not to appear, keep camera off and use chat only.

D. Team licences

Each seat is for one named user. Transfers allowed only before the course starts or as permitted by your enterprise agreement
